1. General Provisions

These Terms and Conditions ("Terms") govern the use of the website dether.ro ("Website") and all purchases made through it. The Website is operated by Ether Collection S.R.L., a company registered in Romania, with its registered office at Aleea Teișani 89, Camera 1, Sector 1, București, Tax Identification Number (CIF): 51198965, Trade Register Number: J2025005844004 (hereinafter "D'Ether", "we", "us", or "our").

D'Ether is a niche luxury perfumery house specialising in the creation and sale of extrait de parfum compositions. By accessing or using this Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.

These Terms are drafted in accordance with OUG 34/2014 on consumer rights in distance contracts, Law 365/2002 on electronic commerce, and Law 287/2009 (the Romanian Civil Code).

2. Definitions

  • "Customer" or "you" — any natural or legal person who places an order through the Website.
  • "Order" — an electronic document submitted through the Website representing the Customer's intention to purchase Products.
  • "Product(s)" — the extrait de parfum compositions and any other goods offered for sale on the Website.
  • "Contract" — the distance contract concluded between D'Ether and the Customer upon confirmation of an Order.
  • "Business Day" — any day other than Saturday, Sunday, or a public holiday in Romania.

3. Product Information

All fragrances sold by D'Ether are extrait de parfum compositions with a concentration of approximately 35% aromatic compounds — the highest concentration category in perfumery. Each product page contains detailed information about the fragrance notes, concentration, volume, and ingredients.

We make every effort to ensure that product descriptions, images, and pricing displayed on the Website are accurate and up to date. However, we do not warrant that product descriptions or other content on the Website are error-free. Colours and visual representations may vary depending on your display settings.

All Products comply with EU Regulation (EC) No 1223/2009 on cosmetic products and bear the required labelling, including the list of ingredients (INCI), batch number, and period after opening (PAO).

4. Ordering Process

To place an Order, follow these steps:

  1. Browse the Website and add the desired Products to your shopping cart.
  2. Review the contents of your cart and proceed to checkout.
  3. Provide the required delivery and billing information.
  4. Select your preferred payment method.
  5. Review the Order summary, including total price, delivery costs, and these Terms.
  6. Confirm the Order by clicking the "Place Order" button. This action constitutes an offer to purchase under Romanian law.

You will receive an automatic email acknowledging receipt of your Order. This acknowledgement does not constitute acceptance. The Contract is concluded when we send a separate confirmation email confirming that your Order has been dispatched or is being processed for shipment.

We reserve the right to refuse or cancel any Order for reasons including product unavailability, pricing errors, suspected fraud, or non-verification of payment.

5. Prices and Payment

All prices displayed on the Website are in Euros (EUR) and include VAT where applicable. Delivery costs are calculated and displayed separately during checkout before Order confirmation.

We accept the following payment methods:

  • Credit/debit card (Visa, Mastercard)
  • Bank transfer
  • Other payment methods as indicated at checkout

Payment is processed securely through our third-party payment providers. We do not store your full credit card details on our servers. All transactions are encrypted using industry-standard SSL/TLS technology.

We reserve the right to modify prices at any time. The price applicable to your Order is the price displayed at the time of Order placement.

6. Delivery

D'Ether offers international shipping. Delivery is available to the countries listed during the checkout process. Estimated delivery times are:

  • Romania: 1–3 Business Days
  • European Union: 3–7 Business Days
  • Rest of World: 7–14 Business Days

Delivery times are estimates and are not guaranteed. Delays may occur due to customs procedures, courier capacity, or circumstances beyond our control. Risk of loss or damage to Products passes to you upon delivery.

For international orders, the Customer is responsible for any customs duties, import taxes, or additional fees imposed by the destination country. These charges are not included in the purchase price or delivery costs.

All fragrance shipments comply with IATA dangerous goods regulations for perfumery products containing alcohol.

7. Right of Withdrawal

In accordance with OUG 34/2014 (implementing EU Directive 2011/83/EU), you have the right to withdraw from the Contract within 14 calendar days from the date you or a third party indicated by you (other than the carrier) receives the Product, without giving any reason.

To exercise the right of withdrawal, you must inform us of your decision by means of an unequivocal statement (e.g., letter sent by post or email). You may use the model withdrawal form provided below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the 14-day period has expired.

Effects of Withdrawal

If you withdraw from the Contract, we will reimburse all payments received from you, including the cost of standard delivery (except if you chose a delivery method other than the least expensive standard delivery offered by us). The reimbursement will be made without undue delay and no later than 14 days from the date on which we are informed of your decision to withdraw.

We will use the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. You shall bear the direct cost of returning the Products.

We may withhold the reimbursement until we have received the Products back or you have supplied evidence of having sent back the Products, whichever is earliest.

Exceptions to the Right of Withdrawal

In accordance with Article 16 of OUG 34/2014, the right of withdrawal does not apply to sealed Products which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery. Perfume products that have been opened, tested, or used cannot be returned.

8. Warranty and Returns

All Products sold through the Website benefit from the legal conformity guarantee as provided by Romanian law. If you receive a Product that is defective, damaged in transit, or does not correspond to your Order, please contact us within 30 days of receipt.

To initiate a return or report a defect, please email us at [email protected] with your Order number, a description of the issue, and photographic evidence where applicable. We will respond within 5 Business Days and provide instructions for return shipping.

Products must be returned in their original packaging, unused and in the same condition as received. We reserve the right to refuse returns that do not meet these conditions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, D'Ether shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Website or Products.

Our total liability for any claim arising from the Contract shall not exceed the amount paid by you for the specific Product(s) giving rise to the claim.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Romanian law.

Perfume products contain alcohol and allergens. Please read the ingredients list carefully before use. D'Ether shall not be held liable for allergic reactions or skin sensitivity in cases where the Customer has not consulted the ingredient information provided.

10. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, photographs, product descriptions, fragrance compositions, packaging designs, and software, is the exclusive property of Ether Collection S.R.L. or its licensors and is protected by Romanian and international intellectual property laws.

The D'Ether name, logo, and all related product names, designs, and slogans are trademarks of Ether Collection S.R.L. You may not use these marks without our prior written permission.

You may view and print pages from the Website for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, without our express written consent is strictly prohibited.

11. Privacy

Your privacy is important to us. The collection, processing, and storage of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms. Please review it carefully to understand how we handle your personal information in compliance with the General Data Protection Regulation (GDPR) and Romanian data protection legislation.

13. Dispute Resolution

In accordance with EU Regulation 524/2013 on Online Dispute Resolution (ODR), consumers residing in the European Union may submit complaints through the European Commission's ODR platform: https://ec.europa.eu/consumers/odr.

You also have the right to resort to alternative dispute resolution (SAL/ADR) procedures. In Romania, the competent entities for alternative dispute resolution in consumer disputes are listed on the website of the National Authority for Consumer Protection (ANPC) at www.anpc.gov.ro.

If the dispute cannot be resolved through the methods above, either party may submit the dispute to the competent Romanian courts in accordance with applicable law.

14. Applicable Law

These Terms are governed by and construed in accordance with the laws of Romania. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania, without prejudice to any mandatory consumer protection provisions that may grant jurisdiction to the courts of your place of residence.
